1. About these terms

Here Got What is a service operated by YS Tang ("we", "us", "our"), an individual sole trader based in Singapore. These Terms & Conditions ("Terms") govern your use of the Here Got What website and services ("Service"). By creating an account or using the Service you agree to these Terms. If you do not agree, please do not use the Service. You confirm that you are at least 16 years old (or the higher digital-consent age applicable in your country), that you are of legal age to enter into a binding contract where you live, and, if you are using the Service on behalf of an organisation, that you have authority to bind that organisation to these Terms.

2. The Service

Here Got What provides a digital toolkit for tour guides and travelers, including features for discovering places, building tours and storyboards, running live audio tours, and generating AI content such as descriptions, narration and images.

3. Your account

  • You must provide accurate information when creating your account and keep it up to date.
  • You are responsible for keeping your account credentials confidential and for all activity that happens under your account.
  • Tell us immediately if you suspect unauthorised use of your account. We will reset your password, sign you out of all sessions and review recent activity with you.
  • You can delete your account at any time from Account → Delete my account. Deletion permanently removes your profile, photos, narration audio, storyboards, credit balance and personal data. Tours, tour stops and Local Gems you contributed stay visible to the community under "Former contributor", because other travellers may already rely on them.

4. Acceptable use

You agree not to misuse the Service. In particular, you must not:

  • Use the Service for unlawful, harmful, harassing, defamatory or fraudulent purposes.
  • Upload or share content that infringes intellectual property, privacy or other rights.
  • Probe, scan, scrape or otherwise interfere with the security or integrity of the Service.
  • Distribute malware or attempt to gain unauthorised access to any part of the Service or related systems.
  • Resell, sublicense or redistribute the Service without our written permission.
  • Reverse engineer, decompile or attempt to extract the source code, except as permitted by law.

5. Generative AI features

The Service includes features that generate content using AI models ("AI Features"). When you use AI Features:

  • You are responsible for the prompts and inputs you submit and for how you use the resulting outputs.
  • You must have the rights to any content you upload (photos, audio, text) and grant us a limited licence to host and process it solely to provide the Service.
  • You must not use AI Features to generate illegal content, deepfakes of real people without consent, hate speech, sexual content involving minors, malware or content designed to harass or defraud, or to attempt to bypass safety controls ("jailbreaking").
  • AI outputs may be inaccurate, incomplete or offensive. You should verify outputs before relying on them. AI outputs are not professional advice (legal, medical, financial or otherwise).
  • We may filter, refuse or remove outputs and may suspend accounts that repeatedly violate these rules.
  • If you believe AI‑generated content infringes your rights, contact us at hello@heregotwhat.app. We will review and, where appropriate, remove the content and take action against repeat infringers.

5a. No selling, advertising or off-platform contact

Here Got What is a place to share stories about places — not a marketplace. Tour guides and contributors must not use tours, stops, hidden gems, storyboards, photos, narration or any other user content to:

  • Sell, advertise, promote or solicit bookings for paid tours, transport, tickets, accommodation, products or services.
  • Display contact information of any kind — phone numbers, email addresses, WhatsApp / Telegram / WeChat / Line / Signal / Viber handles, social-media handles or usernames (e.g. @yourname), or links to personal, social or commercial websites.
  • Include promo codes, affiliate links, referral codes, QR codes that resolve to commercial pages, or instructions to "DM me", "message me", "find me on …".
  • Solicit payments, tips, donations or off-platform transactions.

Our moderation system automatically rejects user content that contains links, emails, phone numbers, social handles or messaging-platform references. Accounts that repeatedly attempt to sell or advertise will be suspended or terminated and their content removed without refund.

Tokens spent on auto-rejected AI content. Tokens consumed to generate content that is then auto-rejected by moderation (for example, an AI tour draft whose stops contain disallowed promotional text) are not refunded, because the AI work has already been performed and billed by our providers. You can edit the offending content and re-submit it for moderation at no additional cost.

5b. User-submitted locations and information

Tours, stops, hidden gems and storyboards are user-generated content. GPS coordinates, addresses, opening hours, prices, descriptions, narration and stories are provided "as is" by the contributor and may be inaccurate, outdated, incomplete or misleading.

  • If you are a contributor, you must take reasonable care to check the accuracy of pin locations and information before publishing.
  • If you are a visitor, you are responsible for verifying locations, opening hours, safety and access before traveling, and for following local laws and the rules of any private property.
  • To the fullest extent permitted by law, Here Got What is not liable for any loss, injury, damage, delay or inconvenience arising from inaccuracies in user-submitted locations or information, or from your reliance on them.

6. Your content

You retain ownership of the content you upload to the Service. You grant us a worldwide, non‑exclusive, royalty‑free licence to host, store, process, display and transmit your content solely as needed to provide and improve the Service. You are responsible for ensuring you have the rights to share any content you upload.

7. Our intellectual property

The Service, including its software, design, branding and documentation, is owned by Here Got What or its licensors and is protected by intellectual property laws. We grant you a limited, non‑exclusive, non‑transferable right to use the Service in accordance with these Terms and any plan you subscribe to.

8. Payments, tokens and usage limits

Here Got What runs on a pay-as-you-go token model. 1 token = US$0.01 of usage. Tokens are purchased in one-time packs and never expire. There are no subscriptions, no recurring charges and no inactivity fees.

Manual tour creation, adding stops yourself, browsing, uploading photos (within your storage cap), liking and flagging are free. Tokens are only spent when you use the optional paid features: AI tour generation (4 tokens for the free trial, 5 tokens once you've topped up, up to 20 stops), bulk translation into another language (3 tokens per language per tour), AI text-to-speech narration (8 tokens per 1,000 characters, rounded up), and live broadcasting (0.2 tokens per minute, rounded up).

Free and trial accounts are subject to daily and lifetime contribution limits to keep the platform sustainable: up to 3 hidden gems and 3 short stories per day, a lifetime cap of 50 photos, and 100 MB of total storage. The 100 free trial tokens granted at sign-up can be used on any paid feature.

Paid token accounts (any wallet that has ever purchased a token pack) have no daily contribution caps and no lifetime photo cap. Total stored content (photos, narration audio, storyboards) is bounded only by a 1 GB storage cap per account. We may adjust these limits with reasonable notice.

Payments are processed by Stripe. Here Got What is the seller of record for all orders. Applicable taxes are calculated and collected at checkout where required.

Inactive accounts. Accounts that have not signed in for 12 months have their storage cap reduced to 100 MB and their oldest media auto-deleted to fit under that cap. Accounts that have not signed in for 24 months have all remaining media deleted and their tours / Local Gems anonymised under "Former contributor". We send a warning email 30 days before each step. Signing in at any point resets the clock. Your wallet balance is never expired by inactivity.

9. Refunds

See our Refund Policy. In short: unused token balances are refundable within 14 days of purchase on request; tokens already spent on AI generation, translation, narration or live-broadcast minutes are non-refundable once the output has been produced.

9a. Live voice (Agora, optional, bring-your-own-key)

Live audio for tours is powered by Agora and is entirely optional. Tours work end-to-end without it. If you choose to enable live voice:

  • You supply your own Agora App ID and App Certificate ("bring your own key"). Your account, billing relationship and usage are between you and Agora.
  • Your use of Agora is governed by Agora's Terms of Service and Privacy Policy. You are responsible for reading and complying with them.
  • Agora currently offers 10,000 free voice minutes per month per account. Once that free tier is exhausted, Agora bills you directly at Agora's then-current rates.
  • Here Got What does not receive any share of, commission on, or revenue from your Agora usage. We do not bill you for live voice minutes.
  • To the fullest extent permitted by law, Here Got What is not liable for any Agora outages, billing disputes, account suspensions, data handling by Agora, or any consequence of you breaching Agora's terms.
  • You can stop using live voice at any time by removing your Agora credentials from your account.

10. Service availability

We work hard to keep the Service running smoothly but we do not guarantee that it will be uninterrupted, error‑free, or always available. We may modify, suspend or discontinue features at any time.

11. Suspension and termination

We may suspend or terminate your access to the Service if:

  • You materially breach these Terms or our acceptable use rules.
  • You fail to pay fees when due.
  • We reasonably believe your account poses a security or fraud risk.
  • We are required to do so by law.

On termination, your right to use the Service ends immediately. You will be given a reasonable opportunity to export your content unless prohibited by law.

12. Disclaimers

The Service is provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability, fitness for a particular purpose and non‑infringement.

13. Limitation of liability

To the fullest extent permitted by law, Here Got What will not be liable for any indirect, incidental, special, consequential or punitive damages, or for loss of profits, revenue, data or goodwill. Our aggregate liability arising out of or relating to the Service will not exceed the fees you paid us in the twelve (12) months preceding the event giving rise to the claim. Nothing in these Terms excludes liability that cannot be excluded under applicable law (such as for fraud, death or personal injury caused by negligence).

14. Indemnity

You agree to indemnify and hold Here Got What harmless from claims, damages and costs arising out of (a) content you upload, (b) your unlawful use of the Service, or (c) your breach of these Terms.

14a. Copyright complaints and notice-and-action

We respect intellectual property rights and respond to clear notices of alleged infringement under the U.S. Digital Millennium Copyright Act (DMCA) and the EU Digital Services Act (DSA, Article 16). To submit a notice, email hello@heregotwhat.app with the subject line "Copyright notice" and include:

  • Your full name, postal address, phone number and email.
  • A description of the copyrighted work (or other right) you claim has been infringed.
  • The URL(s) on Here Got What of the allegedly infringing material so we can locate it.
  • A statement that you have a good-faith belief that the use is not authorised by the rights holder, its agent, or the law.
  • A statement, under penalty of perjury, that the information in the notice is accurate and that you are the rights holder or authorised to act on their behalf.
  • Your physical or electronic signature.

We will acknowledge valid notices, remove or disable access to the reported content where appropriate, and notify the affected uploader with a statement of reasons. The uploader may submit a counter-notice or appeal by replying to that statement within 30 days. We will reinstate content if the counter-notice is valid and the original complainant does not start legal proceedings within 10 business days. We may terminate the accounts of repeat infringers.

14b. Reporting other illegal or harmful content

To report content you believe is illegal or violates these Terms (for example, scams, harassment, doxxing, or unsafe location information), use the in-app "Flag" control on the relevant tour, stop, gem or storyboard, or email hello@heregotwhat.app. We aim to review reports within 14 days and will notify both the reporter and the affected user of the outcome, with a short statement of reasons. Either party may appeal the decision by replying within 30 days; appeals are reviewed by a person who was not involved in the original decision.

15. Changes to these terms

We may update these Terms from time to time. If a change is material we will give reasonable notice (for example, via email or in‑product). Continued use of the Service after the changes take effect means you accept the updated Terms.

16. Governing law

These Terms are governed by the laws of Singapore, without regard to its conflict of laws rules. Disputes will be resolved by the courts of Singapore, except where mandatory consumer protection law gives you the right to bring proceedings in the courts of your country of residence.
